These Terms of Use govern your access to and use of the HVACPRO360 website, account features, and related online services (collectively, the "Site"). In these terms, "HVACPRO360," "we," "us," and "our" mean HVACPRO360. By using the Site, you agree to these terms and our Privacy Policy. Purchases are also governed by our Terms and Conditions of Sale.

ELIGIBILITY AND ACCOUNTS

You must be legally able to enter into a binding agreement to use the Site. If you create an account, you must provide accurate, current information and keep your credentials confidential. PRODUCT INFORMATION

We work to keep Site information accurate, but product descriptions, images, specifications, availability, and pricing may contain errors or change. Confirm the product's current manufacturer documentation and suitability for your application before purchase or installation. HVAC equipment must be installed and serviced by qualified professionals in accordance with applicable laws, codes, permits, and safety requirements.

INTELLECTUAL PROPERTY

The Site and its text, graphics, designs, logos, photographs, software, and other content are owned by HVACPRO360, its licensors, or their respective owners and are protected by applicable intellectual-property laws. HVACPRO360 names and logos may not be used without our prior written permission. Third-party product names, marks, and logos belong to their respective owners.

USER CONTENT AND FEEDBACK

If you submit reviews, comments, photos, or other content, you represent that you have the right to submit it and that it does not violate law or another person's rights. You grant HVACPRO360 a non-exclusive, worldwide, royalty-free license to use, reproduce, display, and distribute that content to operate, promote, and improve the Site and our services. We may remove content that violates these terms or applicable law.

THIRD-PARTY SERVICES

The Site may contain links to third-party websites, products, or services. Those third parties are responsible for their own content, availability, and practices. A link does not mean that HVACPRO360 endorses or controls the third party.

DISCLAIMERS

To the fullest extent permitted by law, the Site is provided "as is" and "as available." HVACPRO360 does not guarantee that the Site will be uninterrupted, secure, error-free, or free of harmful components. Nothing in these terms excludes or limits any warranty, remedy, or consumer protection that cannot be excluded or limited under applicable law.

LIMITATION OF LIABILITY

To the fullest extent permitted by law, HVACPRO360 will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising out of or related to your use of, or inability to use, the Site. Nothing in these terms limits liability that cannot lawfully be limited, including liability for intentional misconduct or gross negligence.

INDEMNIFICATION

To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless HVACPRO360 and its officers, employees, contractors, and service providers from claims, damages, liabilities, and expenses arising from your unlawful use of the Site, your breach of these terms, or your violation of another person's rights.

ELECTRONIC COMMUNICATIONS

You agree that we may provide notices and other communications electronically where permitted by law. Electronic transactions are governed, where applicable, by Massachusetts General Laws chapter 110G and other applicable law.

GOVERNING LAW AND VENUE

These terms and disputes relating to the Site are governed by the laws of the Commonwealth of Massachusetts, without regard to conflict-of-law rules. Any action must be brought in a state or federal court located in Massachusetts, unless applicable law requires a different forum. Nothing in these terms limits rights or remedies that cannot be waived under Massachusetts or federal law.

CHANGES AND TERMINATION
